Now responsibility of Declaring correct import or export product, Importability of product, Assessment of Rate of duty, Claim of exemption notifications and Imposition of anti-dumping duty including valuation has been shifted to the Importers and Exporters. Now Customs department has limited their role to check the violations done by the Importers and Exporters in their assessed import and export consignments. In coming years, there will remain only surprise checks by the Customs department. The new regime will increase the number of adjudication cases by the Customs and the amount of penalties will definitely rise.

Clearance of Project Imports

Project Imports are covered under chapter 98 of ITC HS Classification under one Customs tariff heading. Project Imports cover all goods, which are being imported for initial setting up of a unit or substantial expansion of an existing unit. Industrial Plants, Irrigation Projects, Power Projects, Mining Projects, Oil Exploration Projects and certain other projects as notified by the government are covered under the scheme. Effective duties under Project Imports are lower than the normal import duty. It depends on the kind of Project. EPCG can also be availed of along with the Project Imports. We can help to get registration of Project imports with the relevant customs house and clear the consignments from Customs department. Re-Importation of Indigenously Manufactured / Imported Goods

Often goods indigenously manufactured when exported are returned back for various reasons including cancellation of export order or supply incorrect quantity or wrong supply or return of goods after exhibition / display etc. The Machines return after use in particular project / contract or after completion of the contract. Imported goods which may have discharged duties at the time of original importation have also to be often sent out for repair, reconditioning etc. Private, personal imported property may also have to be sent abroad for repair within the warranty period and returned. There are also goods which may have to be sent for special processes like electroplating, polishing or coating and re-imported.

100% EOU/STP/EHTP/ BTPS Import Clearance

The Units which undertake to export their entire production of goods and services (except permissible sales in DTA), may be set up under the Export Oriented Unit (EOU) Scheme, Electronics Hardware Technology Park (EHTP) Scheme, Software Technology Park (STP) Scheme or Bio-Technology Park (BTP) Scheme for manufacture of goods, including repair, re-making, reconditioning, re-engineering and rendering of services. Trading units are not covered under these schemes.An EOU / EHTP / STP / BTP unit may import and /or procure, from DTA or bonded warehouses in DTA / international exhibition held in India, without payment of duty, all types of goods, including capital goods, required for its activities, provided they are not prohibited items of import in the ITC (HS). Any permission required for import under any other law shall be applicable. Units shall also be permitted to import goods including capital goods required for approved activity, free of cost or on loan / lease from clients. Import of capital goods will be on a self certification basis. Goods imported by a unit shall be with actual user condition and shall be utilized for export production.

Re-Exportation

There is often occasions where imported goods may have to be re-exported. Such situations arise where the import goods found defective after customs clearance or these are not found according to specifications or requirements of the Indian consignee. Various machinery items after import for use in certain projects or otherwise are also often sought to be re-exported by the original owner. Re-exports can be made by sea, air, baggage or post.
